BrainFlex - Terms of Service
Effective Date: December 4, 2025
These Terms of Service (“Terms”) govern your access to and use of the BrainFlex mobile application and related services (“BrainFlex” or the “Service”), available on iOS, Android, and the web. Please read these Terms carefully before playing.
By installing, accessing, or using BrainFlex, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old, or the minimum age required in your jurisdiction, to use BrainFlex without parental consent.
If you are under the age of majority in your region, you represent that a parent or legal guardian has reviewed and accepted these Terms on your behalf.
If BrainFlex is used by children under 13, a parent or legal guardian must provide any consent required by applicable privacy laws (such as COPPA or GDPR-K).
2. License to Use the Service
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use BrainFlex for your personal, non-commercial use, subject to these Terms.
You may not copy, modify, distribute, sell, or lease any part of BrainFlex unless expressly permitted in writing.
3. Gameplay Rules
Users must follow these rules:
Treat others respectfully.
Do not cheat, exploit bugs, or use unauthorized automation, bots, or scripts.
Do not upload or share content that is illegal, defamatory, hateful, harmful, or infringing.
Do not create multiple accounts to gain unfair advantage.
We may investigate suspected misconduct and may reset progress, restrict features, or suspend accounts that violate these rules.
4. Virtual Items and Purchases
BrainFlex may offer virtual currency, boosts, cosmetic items, or other in-app content (“Virtual Items”). Virtual Items:
Have no real-world monetary value,
Cannot be redeemed for cash or transferred outside the Service,
Are licensed, not sold.
All purchases are final unless required by applicable law.
Store-specific disclosures:
Purchases made on the Apple App Store are processed by Apple and subject to Apple’s terms.
Purchases made on Google Play are processed by Google and subject to Google’s terms.
BrainFlex Studios does not store or have access to your payment information.
If BrainFlex ever offers subscriptions, you may manage or cancel them through your Apple ID or Google Play account settings.
5. Prohibited Conduct
You agree not to:
Reverse engineer, decompile, or attempt to extract source code.
Attempt to bypass, disrupt, or interfere with servers, APIs, analytics, or security features.
Use the Service for commercial purposes without written permission.
Engage in fraud or harmful behavior that disrupts the gameplay experience for others.
6. Intellectual Property
All trademarks, logos, artwork, gameplay content, software, and other materials within BrainFlex are owned by BrainFlex Studios or its licensors and are protected by intellectual property laws.
Nothing in these Terms grants you ownership of any content. You may not reproduce, distribute, modify, or create derivative works without written consent.
7. Privacy
Your use of BrainFlex is also governed by our Privacy Policy.
The Privacy Policy explains how we collect, use, and safeguard personal data.
8. Suspension and Termination
We may suspend or terminate access to the Service at any time if:
You violate these Terms,
We detect fraud or unlawful activity,
Required by law or platform policies, or
We discontinue or modify the Service.
You may stop using BrainFlex at any time. Deleting the app does not relieve you of obligations incurred before termination.
Data retention:
Upon termination, we will retain or delete personal data in accordance with our Privacy Policy and applicable law. We may retain data as necessary for security, fraud prevention, or legal compliance.
9. Disclaimer of Warranties
BrainFlex is provided “as is” and “as available.”
To the fullest extent permitted by law, we disclaim all warranties—express, implied, or statutory—including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Gameplay may be interrupted for maintenance, updates, or technical issues.
10. Limitation of Liability
To the maximum extent permitted by law, BrainFlex Studios and its partners are not liable for:
Indirect, incidental, special, exemplary, or consequential damages,
Loss of data, revenue, profits, or goodwill,
Any damages arising from the use or inability to use the Service.
Jurisdictional Exception
Some regions do not allow certain warranty disclaimers or liability limitations. In those regions, these provisions apply only to the extent permitted by law.
11. Changes to These Terms
We may update these Terms to reflect changes to gameplay, operations, or legal requirements.
If changes materially affect your rights, we will notify you in-app. Continued use of BrainFlex after updated Terms take effect constitutes acceptance.

BrainFlex (“we,” “us,” or “our”) provides an educational game available on iOS, Android, and the web (“Service”). This Privacy Policy explains how we collect, use, disclose, and protect personal information when you use BrainFlex.
By using BrainFlex, you agree to this Privacy Policy. If you do not agree, please do not use the Service.

All payment processing is handled by Apple App Store or Google Play Store.
We do not receive or store your credit card or payment information.
We may receive confirmation of your purchase or a transaction ID for granting virtual items.
1.4 User Content
If BrainFlex includes areas where you may submit content (e.g., text input or player name), we may collect and store that content as part of the Service.
2. Children’s Privacy
BrainFlex may be used by children with parental consent.
If a user is under 13 (or the minimum age in their region), a parent or guardian must approve the use of the app.
We do not knowingly collect personal information directly from children without parental consent as required by COPPA, GDPR-K, and similar laws.
If we learn that we have collected such data without proper consent, we will delete it promptly.
